Honestly it doesn't look like they would've known anyone already claimed it.
You got out of the chopper, in spawn, at the start of the round, twice, before it even moved and you're super lucky your shot didn't kill them. They could've reasonably thought someone spawned in it and switched to the gunner seat immediately like many people do. In the future, I suggest flying 30m in any direction and then swapping.
