Sorry but you were locking on with your heatseekers. While it was cutting it close, you were fair game when you died. You may try to argue that you didn't shoot but it's no different than a recon using a PLD from uncap, you did engage. Thanks for the report but nothing will be done in regard to this player.

While I had a lock on a chopper, I never fired, watch the video closely, he fired the minute the skids took off the ground. And there is no way he knew I was using air to air. Intent follow through and video show the spawn kill.

There’s no guarantee the shot would’ve hit and you were also high above your uncap, to the point that you could be considered out of uncap. If it had been a jet or aa locking you, that’d be different. Call it luck or bad luck in your case, but you were fair game at the time of death.

This same line of thinking has been applied to similar cases.
