In this case you were fair game.
Jets that spawn in the air are not technically in uncap.
That said don't attack them immediately or wait for them to spawn.
A good rule of thumb is to try and spot them, if the base AA attacks them they are way too close to uncap (the only way to ban for uncap attack is if you do not fire and they do as soon as you spawn)

Jets that spawn in the air are a grey area, let us know if he continues.
 
Well this guy repeatedly was behind the jets at spawn and killing us before we could even react. BTW we were high enough and far enough behind spawn Base AA was useless.

As I understand the explanation, an above average Jet Pilot can sit behind enemy spawn and continually get jet kills without opposing team able to fight back, and without fear of Admin repercussion?
 
I understand that it may be hard to get but if you had footage of the jet circling spawn / waiting for spawns that would be grounds for action. Like I said this snippet is a grey area because it isn’t instant as you take the time to fly extremely high.
