You cannot claim vehicles. Sitting in a vehicle and only occupying 1/2 seat slots in spawn invites someone to swing by and hop in.
Refusing to gun in the chopper after it becomes occupied may result in unexpected consequences if it occurs again.

You were spamming commands and focused on telling him to get out instead of playing your role as the gunner.
Not sure why you chose to report this. Vehicle theft is only punishable if someone steals your vehicle that you were using. In this case, you were the gunner of the attack chopper in base without a pilot. I don't know about you but common sense would tell me as a player that if someone is sitting in spawn without both seats of a vehicle occupied, they'd probably like help in effectively using that vehicle.
If the player in question had chat disabled, he or she wouldn't know that you were waiting for a friend; instead, they'd just see you as a dogshit gunner who didn't do anything to help.
You're allowed to wait for people that you know will do a great job but if that means waiting 2-10 minutes for them to spawn in, you'd be better off not wasting that vehicle and to let someone else use it instead.
